LendRV is a rental marketplace of TravelDRDLendRV is a rental marketplace of TravelDRDThese Terms of Service ("Terms") are a binding legal agreement between you and Free Land Vacations, the company behind the TravelDRD and LendRV brands ("LendRV," "TravelDRD," "Free Land Vacations," "we," "us," or "our") that govern your access to and use of the LendRV website, mobile experiences, and related services (together, the "Platform"). LendRV is a peer-to-peer rental marketplace based in South Florida that connects owners of RVs, campers, boats, cars, golf carts, and Jeeps with people who wish to rent them.
Please read these Terms carefully. By creating an account, browsing, listing a vehicle, booking a rental, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Insurance & Protection terms, each incorporated by reference. If you do not agree, do not use the Platform.
LendRV operates a marketplace only. We provide the technology that lets Owners list vehicles and vessels and lets Renters find and book them. The rental itself is a direct agreement between the Owner and the Renter. LendRV is not a party to that rental agreement and is not a rental car company, RV dealer, broker, charter operator, carrier, or insurer.
We do not own, sell, resell, furnish, operate, control, manage, inspect, deliver, or store any vehicle or vessel listed on the Platform. We do not guarantee the existence, quality, safety, roadworthiness, seaworthiness, legality, or accuracy of any listing, and we do not guarantee the conduct of any Owner or Renter.
You are responsible for all activity that occurs under your account and for keeping your login credentials confidential. Notify us immediately of any unauthorized use. You may not create an account for anyone else, share an account, or maintain more than one account without our permission.
To help keep the community safe, we or our third-party providers may verify your identity, driver's license, and — where applicable — driving or boating history, and may re-verify at any time. Bookings may be conditioned on passing verification. We may decline, suspend, or cancel a Booking or account if verification cannot be completed or if information appears inaccurate. Verification is not a guarantee of any user's identity, fitness, or conduct.
A Renter submits a Booking request; no charge is finalized until the Owner approves it and the Booking is confirmed. A confirmed Booking forms a direct rental agreement between the Owner and the Renter, incorporating the listing terms and any additional rental or waiver documents the Owner requires (including check-in agreements). You agree to review and honor those documents.
Payments are processed by our third-party payment providers. By using the Platform, you authorize us and our providers to charge your payment method for the rental price, applicable service fees, deposits, taxes, and any amounts you owe under these Terms or a Booking. LendRV may charge Renters and/or Owners a service fee, which is disclosed before you confirm. Owner payouts are released after the trip according to the payout schedule and any holdback shown to Owners. You are responsible for any bank, card, or currency fees charged by your provider.
A refundable security deposit or pre-authorization may be required for certain Vehicles. It may be applied toward damage, cleaning, late returns, fuel/charging, fines, missing items, prohibited use, or other amounts owed. Any remaining balance is released per the timeline disclosed at Booking. Charges may exceed the deposit, and you remain responsible for the difference.
You are responsible for determining, collecting, remitting, and reporting any taxes applicable to your transactions, except where LendRV or its providers are required by law to collect and remit them. Owners are responsible for the tax treatment of their rental income.
The cancellation policy that applies to a Booking is shown at the time of Booking and forms part of your agreement. Refunds, if any, are issued according to that policy and may be net of non-refundable service fees and payment-processing costs. Owners who cancel confirmed Bookings may be subject to fees and may affect their standing on the Platform. In limited cases (for example, safety or misrepresentation), LendRV may cancel a Booking and issue refunds at its discretion.
Any protection or damage-limitation program offered through the Platform is described on our Insurance & Protection page and applies only subject to its terms, conditions, limits, deductibles, exclusions, and verification requirements. Such protection is not an insurance policy sold by LendRV and is not a substitute for an Owner's own primary insurance or a Renter's personal coverage. Certain vehicle categories, uses, drivers, or areas may be excluded. You are responsible for confirming you have adequate coverage before you list or rent. Read that page carefully.
Renters are responsible for loss of or damage to a Vehicle and its equipment during a rental, up to the full repair or replacement value, plus related costs such as towing, storage, diminished value, and loss of use, subject to any applicable protection program. Owners must document a Vehicle's condition and report damage promptly with photos and detail. LendRV may, but is not obligated to, help facilitate a claim, may collect or charge amounts owed to the payment method on file, and may act as a limited payment collection agent between the parties. You agree to cooperate in good faith with any claim.
You agree not to:
You retain ownership of Content you submit, but you grant LendRV and TravelDRD a non-exclusive, worldwide, royalty-free, sublicensable license to host, use, reproduce, adapt, publish, and display that Content in connection with operating and promoting the Platform. You are responsible for your Content and represent that you have the rights to share it and that it does not violate any law or third-party right. We may remove Content that violates these Terms.
Reviews and ratings must be accurate and based on a genuine transaction. We may remove reviews that violate these Terms, but we do not guarantee that reviews are accurate or unbiased.
The Platform, including its software, design, text, graphics, logos, and the LendRV and TravelDRD marks, is owned by Free Land Vacations or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Platform under these Terms, no rights are granted to you.
THE PLATFORM AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LENDRV DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LISTING, VEHICLE, OWNER, OR RENTER IS SAFE, SUITABLE, OR LAWFUL. YOU USE THE PLATFORM AND RENT OR LIST VEHICLES AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, LENDRV, TRAVELDRD, AND FREE LAND VACATIONS, AND THEIR OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH ARISING OUT OF OR RELATING TO THE PLATFORM OR ANY RENTAL, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF THE SERVICE FEES WE RECEIVED FROM YOU FOR THE BOOKING GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless LendRV, TravelDRD, and Free Land Vacations and their officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your Content, your listing or rental of any Vehicle, your violation of these Terms, or your violation of any law or third-party right. You also release LendRV from claims arising out of disputes between you and any other user.
Please read this section carefully — it affects your legal rights.
You and LendRV agree to first try to resolve any dispute informally by contacting us. If we cannot resolve it within 60 days, you and LendRV agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Platform will be resolved by final and binding individual arbitration, administered by a recognized arbitration provider under its consumer rules, rather than in court, except that either party may bring an individual claim in small-claims court.
Class-action waiver: disputes will be arbitrated only on an individual basis, and you and LendRV waive any right to participate in a class, collective, or representative action. The arbitration will take place in, or be governed by the courts of, the State of Florida unless otherwise required by law. Nothing here prevents either party from seeking injunctive relief in court to protect intellectual-property or Platform-security rights.
You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms to the contact address below.
These Terms and any dispute are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and, where applicable, the Federal Arbitration Act. Subject to Section 21, the state and federal courts located in Florida have exclusive jurisdiction over matters not subject to arbitration.
You may stop using the Platform at any time. We may suspend or terminate your access, remove listings or Content, or cancel Bookings at our discretion, including for violation of these Terms, risk to the community, or legal reasons. Sections that by their nature should survive termination (including payment obligations, disclaimers, liability limits, indemnity, and dispute resolution) will survive.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Platform after changes take effect means you accept the updated Terms.
These Terms, together with the Privacy Policy, Insurance & Protection terms, and any Booking or rental documents, are the entire agreement between you and LendRV regarding the Platform. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship. You agree to receive communications from us electronically.
